  • Hosting: choose an EU data center, ideally in Germany, with your company as the contracting party, so the data processing agreement is signed directly with you.
  • Code and design files: the source code, images, font files and any design files are handed over at the end of the project.
  • Google accounts: you own the Business Profile, Search Console and analytics properties; the agency gets manager access.

Keep a single access register with account name, owner, authorized users and renewal date, and review it once a year. Share passwords through a password manager rather than chat, and rotate them when the project closes.

During the proposal stage, ask one direct question: "If we stopped working together tomorrow, how would you hand the site to another team?" A short, specific answer is a good sign; vague reassurance is not.

  • Forms: protect them against spam with methods that do not frustrate real users.

Legal basics for a website in Germany

A commercial website aimed at Germany follows German rules regardless of where its owners or developers are based. The points below are general information, not legal advice; have your specific case checked by a German lawyer (Rechtsanwalt).

  • Impressum: § 5 of the Digitale-Dienste-Gesetz (DDG), in force since 14 May 2024 and replacing the TMG, requires provider details such as company name, address, contact, register entry and VAT ID. Regulated professions add their chamber, legal job title, the state that granted it and the professional rules.
  • Data protection: the DSGVO (GDPR) requires a privacy policy, and providers such as booking tools or hosts need a processing agreement under Art. 28.
  • Consent: § 25 TDDDG requires consent before storing or reading information on a device unless it is strictly necessary; analytics and ad tags wait for consent, and Google also requires consent mode for EEA users.
  • Accessibility: the Barrierefreiheitsstärkungsgesetz (BFSG) applies since 28 June 2025 to many consumer facing shops and services; micro enterprises providing services are exempt. Check whether it applies to you.
  • Online shops: the order button must clearly state the payment obligation, for example "zahlungspflichtig bestellen" (§ 312j BGB), and consumers need withdrawal information.

International teams sometimes copy an Impressum from a parent company abroad. Instead, write it for the German entity that actually operates the site.

Relaunching without losing rankings
