10German Legal Basics for an English Language Site
An English website run by a German business follows German rules, whatever language it is written in. These points should be in place before launch; we implement the technical side, and the legal texts should be reviewed by a lawyer (Rechtsanwalt).
- Impressum: business websites need provider identification under § 5 DDG, the Digitale-Dienste-Gesetz, which replaced the TMG on 14 May 2024.
- Privacy policy: as soon as personal data is processed, even through a contact form, the GDPR requires a clear notice.
- Consent: under § 25 TDDDG, cookies and similar access to devices that are not strictly necessary may only load after consent, analytics and advertising included.
- Accessibility: since 28 June 2025 the Barrierefreiheitsstärkungsgesetz applies to many consumer facing online shops and services; micro enterprises offering services are exempt. Check whether it applies to you.
- Online shops: the order button must be unambiguous under § 312j BGB, for example "zahlungspflichtig bestellen", plus withdrawal information for consumers.
Make sure the consent banner offers an equally easy reject option and that maps and embedded videos load only after a click. Translating the German legal pages into English is a courtesy for readers, but keep the German versions as the reference text.
11Relaunching Without Losing Search Traffic
